Purpose
These terms govern a Shopify merchant's use of the Parcelgrove app. Parcelgrove is a trade name of ECOM XCLUSIVE MASTERY LLC: that company is the merchant's counterparty. By installing the app, the merchant accepts these terms; a merchant who does not accept them need only uninstall it.
The service
Parcelgrove retrieves the store's fulfillments from Shopify, queries carriers, shows a tracking page in the merchant's branding, sends notification emails and produces shipping analytics.
Tracking information comes from carriers. We report it faithfully, but we do not produce it: we do not guarantee its accuracy, its freshness, or the delivery itself. Estimated delivery dates are estimates, not commitments.
Account and merchant responsibilities
The merchant must have an active Shopify store and use the service in the course of their business. They are responsible for what they publish on their tracking page and for what they write in their notification emails.
They warrant that they are entitled to send transactional emails to their customers about their orders, and to entrust us with their data for that purpose. They remain the controller of that data; we are its processor, on the terms of our privacy policy.
Plans, quotas and billing
The service comes in several plans, including a free one. Prices are stated in US dollars and charged by Shopify, through the platform's built-in billing, under Shopify's own rules on charges and refunds.
Each plan includes a monthly parcel quota, reset on the subscription's anniversary date. Going over it interrupts neither the tracking of parcels already taken on nor the emails in flight: it is the month's new parcels that wait for the renewal or for a change of tier.
A discount code offered in exchange for a review applies once, to the following payment, within its validity period.
Acceptable use
The merchant agrees not to:
- use the service to send unsolicited messages
- resell the service or make it available to a third party without our agreement
- attempt to access another store's data
- circumvent quotas, rate limits or plan checks
- use the service for unlawful activity or to mislead their customers
Availability and support
We do our best to keep the service available, without committing to a stated uptime figure. Interruptions can happen, in particular because of Shopify, a carrier or a hosting provider.
Support is by email, from the app's Help page or at parcelgrove@gmail.com. We reply within one business day.
Intellectual property
The application, its code, its brand and its content belong to us. The merchant receives a personal, non-exclusive right to use it for the duration of their subscription. The data of their store and their customers belongs to them: we take no rights over it.
Warranties and liability
The service is provided as is. To the extent permitted by law, our liability is capped at the amounts paid by the merchant over the last twelve months, and we are not liable for indirect damages, in particular loss of revenue, of customers or of data.
Term and termination
The merchant may uninstall the app at any time, which ends the subscription for subsequent periods. Their data is then erased within 48 hours.
We may suspend or terminate access in the event of a serious breach of these terms, after warning the merchant except in an emergency.
Changes to these terms
These terms may change. Significant changes are announced to merchants by email; continuing to use the service after they take effect counts as acceptance.
Governing law
These terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules. Mandatory rights granted to consumers and merchants by the law of their country of residence remain unaffected.
